According to the probable cause statement, the two males, identified as Justin Spalding, 20 of Hawk Point and Austin Haffner, 19 of Elsberry were fighting when O’Brien came upon the scene.
Upon questioning, Haffner stated that Spalding had assaulted him. Spalding refused to get out of vehicle he entered when seeing the officer at the scene. He was removed from the vehicle and placed in handcuffs.
Haffner stated he had been receiving threatening text messages from Spalding.
Two witnesses stated that Spalding arrived looking for Haffner and that’s when the fight started.
As O’Brien approached the vehicle he observed a small plastic baggie containing marijuana.
He was given consent to then search the vehicle where he located 6.6 oz. of Marijuana in baggies located in a black binder, $742 in cash and a black scale.
Spalding stated everything found in the vehicle did belong to him. He was then transported to the Lincoln County Mercy Hospital to check for injuries.
While at the hospital, a small baggie containing Xanax pills fell out of Spaldings shoe.
Spalding was then transported to the Lincoln County Jail to be booked and placed on a twenty-four hour hold for possession with intent to distribute, possession of marijuana over 35 grams and possession of drug paraphernalia.
