Baseball bat used in assault

On June 25, Elsberry Police Officer Michael Bales responded to the 400 block of North 3rd Street in response to an assault call.

On arrival Bales made contact with the victim Robert Golden, who stated that he was struck by Brandon Spies, 19, of Elsberry, three to five times with a baseball bat.

Golden said that he was struck in the neck, head and shoulder area.

According to Golden the assault was not provoked.

Bales stated he spoke to two witnesses who provided him with written statements consistent with Golden’s account of the incident.

The bat was recovered at the scene and identified by Golden and both witnesses as being the weapon used.

Spies stated he beat Golden with the bat because he had been told by an unidentified person that they had heard that Golden wanted to kill Spies.

Spies said the attack was in self-defense.

Bales asked Spies if Golden had made any threats directly to him, or if he had attempted to assault him directly before the incident occurred.

“No, he was walking away when I hit him the first time and he was on the ground for the rest of hit,” Spies told the officer.

Spies was charged with Felony Assault – 2nd Degree. Bail was set at $25,000 cash only.
